Terms of Service
These terms govern access to and use of the FestLink platform by vendors, organizers, and other users.
Effective date: June 28, 2026
FestLink is a marketplace and workflow platform. Vendors and organizers remain responsible for their own decisions, agreements, legal obligations, event operations, and commercial relationships.
1. Acceptance of these terms
By accessing or using FestLink, you agree to these Terms of Service and the Privacy Policy.
If you are using FestLink on behalf of a business or organization, you confirm that you have authority to accept these terms on its behalf.
If you do not agree, do not use the service.
2. Eligibility and accounts
You must be legally able to enter into a binding agreement and provide accurate account information.
You are responsible for your account, password, activity, and all content submitted through your account.
You must promptly notify FestLink if you suspect unauthorized access or misuse.
3. FestLink's role
FestLink provides tools that help vendors discover events, submit applications, manage profiles and documents, and communicate with organizers.
FestLink also provides organizers with tools to publish events, collect applications, review vendors, and manage application decisions.
FestLink is not the organizer, vendor, employer, insurer, payment guarantor, or contracting party for agreements made between users unless expressly stated otherwise.
Users are responsible for independently evaluating each event, vendor, organizer, opportunity, fee, licence, permit, insurance requirement, and commercial arrangement.
4. Vendor responsibilities
Vendors must provide accurate information about their business, products, services, setup, permits, insurance, certificates, photographs, and availability.
Vendors are responsible for meeting all legal, health, safety, licensing, tax, insurance, food-service, fire-safety, and event-specific requirements that apply to them.
Submitting an application does not guarantee acceptance, attendance, sales, revenue, exclusivity, or reimbursement.
5. Organizer responsibilities
Organizers must provide accurate event information, including dates, location, fees, deadlines, requirements, capacity, and cancellation terms.
Organizers are responsible for their events, venues, permits, insurance, safety plans, vendor decisions, communications, refunds, and legal obligations.
Organizers must not misrepresent attendance, opportunities, sponsors, permits, or event status.
6. Applications, approvals, and payments
Application statuses displayed by FestLink are based on information entered by users and may change.
An approval shown on FestLink does not replace a separate contract, permit, invoice, payment confirmation, or organizer instruction.
Unless FestLink expressly provides payment processing for a transaction, payments and refunds are handled directly between vendors and organizers.
FestLink is not responsible for unpaid fees, chargebacks, cancellations, event performance, weather, attendance, revenue, or disputes between users.
7. User content
You retain ownership of content you submit to FestLink.
You grant FestLink a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, and transmit that content as needed to operate and improve the service.
You confirm that you have the necessary rights and permissions to upload and share your content.
FestLink may remove content that is unlawful, misleading, harmful, infringing, unsafe, or inconsistent with these terms.
8. Prohibited use
You may not use FestLink for fraud, harassment, impersonation, discrimination, illegal activity, spam, malware, unauthorized data collection, or infringement of another person's rights.
You may not attempt to bypass security, access another user's account, scrape restricted areas, interfere with the service, or misuse private documents.
You may not publish false events, fabricated opportunities, misleading attendance claims, or fraudulent vendor information.
9. Availability and changes
FestLink may add, remove, suspend, or modify features at any time.
The service may occasionally be unavailable because of maintenance, technical problems, third-party services, security incidents, or circumstances outside FestLink's control.
FestLink does not guarantee uninterrupted, error-free, or permanent availability.
10. Third-party services and links
FestLink may rely on or link to third-party services such as hosting, authentication, storage, email, maps, analytics, social platforms, and payment providers.
Those services may have their own terms and privacy practices.
FestLink is not responsible for third-party websites, services, content, availability, or conduct.
11. Suspension and termination
FestLink may suspend or terminate access where reasonably necessary to protect users, investigate misuse, comply with law, enforce these terms, or protect the platform.
You may stop using FestLink at any time and may request account deletion.
Sections that by their nature should survive termination will continue to apply.
12. Disclaimers
FestLink is provided on an as-is and as-available basis to the fullest extent permitted by law.
FestLink does not guarantee event quality, vendor quality, approval outcomes, attendance, sales, earnings, legal compliance, document validity, insurance coverage, or the accuracy of user-submitted information.
Users should obtain independent legal, tax, insurance, health, safety, and business advice where appropriate.
13. Limitation of liability
To the fullest extent permitted by law, FestLink and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, opportunities, goodwill, or business interruption.
Where liability cannot legally be excluded, FestLink's total liability arising from the service will be limited to the amount paid by the user to FestLink during the three months before the event giving rise to the claim, or CAD $100 if no amount was paid.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply.
14. Indemnity
You agree to be responsible for claims, losses, damages, and reasonable costs arising from your content, event, vendor activity, violation of law, breach of these terms, or infringement of another person's rights.
15. Governing law
These terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law rules.
Subject to any mandatory legal rights, disputes will be brought before the courts located in Ontario, Canada.
16. Changes to these terms
FestLink may update these terms as the service changes.
Material changes may be communicated through the website, dashboard, or email.
Continued use after updated terms become effective means you accept the revised terms.
